SMS Notification

1. Introduction 


The general terms and conditions for use of the service “SMS Notification of the Clients of Stopanska Banka a.d. Bitola (hereinafter referred to as: General Terms and Conditions) for the clients of Stopanska banka a.d. Bitola (hereinafter referred to as: the Bank) define the rights and obligations for use of the service “SMS Notification of the Client of Stopanska Banka a.d. Bitola (hereinafter referred to as: SMS Service).

 2. Characteristics of SMS Service


The SMS Service makes it possible for a client to obtain the following information through SMS message sent to their mobile reported in the Bank when applying for SMS Notification:

  • change of transaction account (natural persons) – monthly fee
  • transaction made via a card, the amount and point of the performed transaction – monthly fee
  • expiration date of the card and where it may be taken over (natural and legal person) – without any fees
  • due deposit interest (natural and legal person) - without any fees
  • due – unpaid loan (natural and legal person) – without any fees
  • Other notifications under a Bank Decision – without any fees

If a client uses more than one products of the Bank (transaction account, payment card, loans, deposits and etc.) , by activating the service, they shall receive SMS notifications for each transaction.

 3. Application for use of SMS Service


The Bank allows for all clients (natural persons) to use SMS service, who have a transaction account in the Bank, payment card for natural and legal persons (debit, credit card), deposits for natural and legal persons, loans for natural and legal persons and etc. To use SMS service, and applicant shall have to complete an application form and submit it in the Bank branches.

 4. Cancellation of SMS Service


A client may temporary cancel the use of SMS service in case of loss / theft of the mobile phone or for any other reason.   The Bank shall temporary block the use of SMS service based on written Request submitted by the service user. Permission for use of SMS service shall be obtained after receipt of a Request thereof submitted by the client. The client may permanently cancel the use of SMS service by submission of written Request for cancellation of the use of SMS service. The Bank, without prior clarification, has the right to cancel SMS service to a client if it establish that: - the client has used the SMS service in opposition to the General Terms and Conditions of the Bank – fails to regularly pay the monthly fee.  The Bank shall inform the client on the decision to cancel the service via SMS message.

 5. Fee for use of SMS Service


The client agrees that the Bank shall charge a fee for the use of SMS service in accordance with the Bank Decision on the Fee Service Tariff. The fees for use of SMS service shall be charged in the beginning of each month from the client’s transaction account without a delivery of a invoice. Provided the client of SMS service lacks sufficient funds on their transaction account, they agree that the Bank, without prior notice on collection of its claims based on fee for the use of SMS service in and on behalf of the client, use the existing funds of the client in the Bank on any grounds or current and future MKD and foreign currency inflows on their accounts in the Bank.

6. Protection of personal data and confidential information


The Bank guarantee for the accuracy of the data, which within the SMS service exit the Bank’s information system. The time of sending the message is the time when the message has exit the Bank’s information system. The Bank guarantee for the data confidentiality and integrity to the time of exit the Bank’s information system. The Bank shall not be held responsible if due to technical problems or temporary interruption of the operation of the mobile operator or the Bank’s authorization system occurs untimely delivery or failure of delivery of the SMS notification to the client.  The Bank shall not be held responsible if in the Application for obtaining and use of SMS service the client submitted incorrect or some other's phone number for delivery of SMS messages. The Customer undertakes to use SMS service in compliance with the General Terms and Conditions and shall inform the Bank on all irregularities related to its use.

7. Final provisions


By delivery of Application for use of SMS service, the Bank and the Client shall conclude Agreement for Use of SMS Service. The Bank may, in compliance with its Business Policy, modify the terms and conditions for use of SMS service and it shall undertake to inform the Client thereof. The Client agrees to be notified on the modifications of the terms and conditions in the manner determined by the Bank. Save the Client fails to agree on the modifications, they may request cancellation of the use of SMS service within 15 days as of the date of publication of the new terms and conditions. In that case they shall be obliged to submit to the Bank written Request for cancellation of SMS service.  Otherwise it shall be deemed that the Client agrees thereof. Possible disputes arising from failure to consistently comply with the General Terms and Conditions shall be settled by way of negotiations between the Client and the Bank, or otherwise they shall be under jurisdiction of the Court in Bitola.
